Terms of Service

These terms govern your use of the Echoforge Podcast website and any production engagement you enter with the studio. Echoforge Podcast is a podcast creation and audio production studio based in Edgewood, Kentucky. By using this site or booking a service you accept these terms, which should be read together with the Podcast Production Terms, the Payment, Cancellation and Refund Policy, and the Intellectual Property and Content Rights policy.

01Who we are

Echoforge Podcast is a podcast creation and audio production studio. We provide concept development, recording support, audio editing and post-production, episode production, branding and show materials, publishing support, and show notes and transcription.

Where these terms say we or us, they mean Echoforge Podcast. Where they say you, they mean the person or business using the site or booking a service.

02Scope of our services

Our work is creative and production-focused. It is important to be clear about what falls outside that scope.

  • We provide podcast creation and audio production services as listed on this site.
  • We do not provide broadcasting operations.
  • We do not provide music licensing or clearance.
  • We do not provide talent representation or booking.
  • We do not provide regulated media services.

Where a project needs any of those, you arrange them separately with an appropriate provider, and we prepare our deliverables to hand off cleanly.

03Using this site

You may browse the site, read the material on it and submit genuine enquiries and bookings. The site, its text, layout and code belong to us or are used with permission.

  • Do not copy substantial parts of the site's content or code for use elsewhere.
  • Do not use automated tools to scrape or replicate the site.
  • Do not attempt to disrupt the site or bypass its security.
  • Do not submit false or automated bookings.

04Bookings and quotes

Opening a service and sending a booking request is an enquiry, not a confirmed engagement. It does not reserve studio time by itself.

After a request we reply, confirm scope, and provide a written quote. An engagement begins only once that quote is accepted and any agreed deposit is paid. Prices shown on the site are starting points in United States dollars and are confirmed in the written quote.

05Your responsibilities

Good production depends on usable source material and timely input. A few things rest with you.

  • Provide recordings and materials in the agreed format and quality.
  • Confirm you have the right to use any voices, music or content you supply.
  • Give feedback and approvals at each stage so the schedule holds.
  • Nominate one person empowered to approve episodes on your side.

Where a project stalls because material or feedback is outstanding, the timeline moves accordingly.

06Turnaround and delivery

Typical turnaround times are shown with each service and confirmed in your quote. They begin once we have the source material and any information we need.

Delivery is digital. Final files are released once the work is complete and any balance due for it is paid.

07Our responsibility

We provide our services with reasonable care and skill and to a professional standard. Audio production involves creative judgement, and we cannot guarantee a particular audience, download or ranking result from the work.

To the extent permitted by law, our total liability for an engagement is limited to the fees paid for that engagement. We are not liable for indirect or consequential loss, including lost audience, revenue or business. Nothing here limits liability that cannot lawfully be limited.

You are responsible for reviewing and approving each episode before it is published. Once you approve a deliverable, responsibility for that approved content passes to you.

08Publishing

Where we assist with publishing, we prepare and hand off files and metadata. Final control over what is published, and on which platforms, remains with you and is subject to each platform's own rules, as set out in the Publishing Disclaimer.

09Availability of the site

We aim to keep the site available but cannot guarantee uninterrupted access. It may be unavailable during maintenance or because of a fault at the hosting provider. We may change or withdraw any part of the site at any time.

10Governing law

These terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to conflict of law principles, and the courts of that jurisdiction have exclusive jurisdiction over any dispute.

Before starting proceedings, both sides agree to raise the concern in writing and attempt to resolve it directly. If any provision is found unenforceable, the rest continue in force.

11Changes to these terms

We may update these terms as the studio's practice develops. The date at the top of the page records when the current version took effect, and continued use of the site after that date indicates acceptance. The version in force when a quote is accepted governs that engagement.
